Terms of Service

These Terms of Service (hereinafter, "these Terms") define the conditions for using the online shop (hereinafter, "this Service") provided on this website. All registered users (hereinafter, "Users") shall use this Service in accordance with these Terms.

Article 1 (Application)

  1. These Terms shall apply to all relationships between Users and the Company regarding the use of this Service.
  2. In addition to these Terms, the Company may establish various rules for the use of this Service (hereinafter, "Individual Provisions"). These Individual Provisions, regardless of their designation, shall constitute a part of these Terms.
  3. If the provisions of these Terms conflict with the provisions of the Individual Provisions in the preceding paragraph, the provisions of the Individual Provisions shall prevail, unless otherwise specifically stipulated in the Individual Provisions.

Article 2 (User Registration)

  1. In this Service, user registration shall be completed when an applicant for registration agrees to these Terms, applies for user registration, and receives notification of approval for the application.
  2. The Company may not approve an application for user registration if it determines that the applicant has any of the following reasons, and shall not be obliged to disclose the reasons.
    a. If false information was submitted in the application for user registration.
    b. If the application is from a person who has violated these Terms.
    c. In any other case where the Company deems the user registration to be inappropriate.

Article 3 (Management of User ID and Password)

  1. Users shall manage their User IDs and passwords for this Service at their own responsibility.
  2. Users may not, under any circumstances, transfer or lend their User ID and password to a third party, or share them with a third party. If a User ID and password combination matches the registered information and a login occurs, it shall be deemed that the user who registered that User ID is using the service.
  3. The Service Provider shall not be liable for any damages caused by the use of User IDs and passwords by a third party, except in cases where the Service Provider has intentional or gross negligence.

Article 4 (Sales Agreement)

  1. In this Service, a sales agreement shall be established when a User applies for a purchase and the Company notifies the User of its acceptance of said application. The ownership of the product shall transfer to the User when the Service Provider hands over the product to the shipping company.
  2. If a User falls under any of the following circumstances, the Company may cancel the sales agreement in the preceding paragraph without prior notice to the User.
    a. If the User violates these Terms.
    b. If product delivery cannot be completed due to an unknown delivery address or prolonged absence.
    c. In any other case where the Company deems the trust relationship with the User to have been compromised.
  3. Payment methods, delivery methods, cancellation methods for purchase applications, or return methods related to this Service shall be in accordance with separately stipulated methods.

Article 5 (Intellectual Property Rights)

The copyrights and other intellectual property rights of product photos and other content (hereinafter, "Content") provided by this Service belong to the Service Provider and the legitimate right holders such as content providers, and Users may not reproduce, reprint, modify, or otherwise make secondary use of these without permission.

Article 6 (Prohibited Acts)

Users shall not engage in the following acts when using this Service.

  1. Acts that violate laws or public order and morals.
  2. Acts related to criminal acts.
  3. Acts that infringe on copyrights, trademark rights, or other intellectual property rights included in this Service.
  4. Acts that destroy or interfere with the functions of the Service Provider's servers or networks.
  5. Acts that commercially utilize information obtained through this Service.
  6. Acts that may interfere with the operation of the Service.
  7. Unauthorized access or attempted unauthorized access.
  8. Acts that collect or accumulate personal information of other Users.
  9. Acts of impersonating another User.
  10. Acts of directly or indirectly providing benefits to anti-social forces in connection with the Service Provider's service.
  11. Other acts deemed inappropriate by the Service Provider.

Article 7 (Suspension, etc. of Provision of this Service)

  1. The Service Provider may suspend or interrupt the provision of all or part of this Service without prior notice to the User if it determines that any of the following circumstances exist:
    a. When performing maintenance, inspection, or updating of the computer system related to this Service.
    b. When the provision of this Service becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters.
    c. When computers or communication lines stop due to an accident.
    d. In any other case where the Service Provider determines that the provision of this Service is difficult.
  2. The Service Provider shall not be liable for any disadvantages or damages incurred by Users or third parties due to the suspension or interruption of the provision of this Service, regardless of the reason.

Article 8 (Restriction of Use and Deletion of Registration)

  1. The Service Provider may, without prior notice, restrict the use of all or part of this Service by a User, or delete the User's registration, if any of the following apply:
    a. If the User violates any provision of these Terms.
    b. If it is found that there is a false fact in the registered matters.
    c. If the credit card registered by the User as a payment method becomes unusable.
    d. If there is a default on payment obligations such as fees.
    e. If there is no response to contact from the Service Provider for a certain period.
    f. If there has been no use of this Service for a certain period since the last use.
    g. In any other case where the Service Provider determines that the use of this Service is not appropriate.
  2. The Service Provider shall not be liable for any damages incurred by the User due to actions taken by the Company based on this article.

Article 9 (Withdrawal)

Users can withdraw from this Service through the prescribed withdrawal procedure.

Article 10 (Disclaimer of Warranties and Limitation of Liability)

  1. This Service does not guarantee that there are no de facto or legal defects (including defects related to safety, reliability, accuracy, completeness, effectiveness, suitability for a particular purpose, security, errors, bugs, infringement of rights, etc.).
  2. The Service Provider shall not be liable for any damages incurred by Users through this Service. However, if the agreement between the provider and the user regarding this service (including these terms) constitutes a consumer contract as defined by the Consumer Contract Act, this exemption provision shall not apply. Even in such a case, the Service Provider shall not be liable for special damages (including cases where the Company or the User foresaw or could have foreseen the occurrence of damages) arising from default or tort due to the Service Provider's negligence (excluding gross negligence).
  3. The Service Provider shall not be responsible for any transactions, communications, or disputes that arise between Users and other Users or third parties regarding this Service.

Article 11 (Changes to Service Content, etc.)

The Service Provider may change the content of this Service or discontinue the provision of this Service without notifying Users, and shall not be liable for any damages incurred by Users as a result.

Article 12 (Changes to Terms of Service)

The Service Provider may change these Terms at any time without notifying Users if it deems it necessary. If a User starts using this Service after the change of these Terms, the User shall be deemed to have agreed to the changed Terms.

Article 13 (Handling of Personal Information)

The Service Provider shall appropriately handle personal information acquired through the use of this Service in accordance with the separately stipulated "Privacy Policy."

Article 14 (Notices or Communications)

Notices or communications between Users and the Service Provider shall be made by the method determined by the Service Provider. The Service Provider shall consider the currently registered contact information as valid and send notices or communications to that contact information unless the User submits a change notification in accordance with the method separately determined by the Service Provider, and these shall be deemed to have reached the User at the time of dispatch.

Article 15 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer or pledge their position under the user agreement or their rights or obligations based on these Terms to a third party without the prior written consent of the Service Provider.

Article 16 (Governing Law)

The interpretation of these Terms shall be governed by Japanese law. The application of the United Nations Convention on Contracts for the International Sale of Goods shall be excluded with respect to this Service.
